Amplyfai, Inc. ("Amplyfai," "we," "us," or "our") is committed to protecting the privacy and security of your information. This Privacy Policy describes how we collect, use, disclose, and protect information when you use our AI-powered social media content generation platform, website (amplyfai.vercel.app), and related services (collectively, the "Service").

By using the Service, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with the practices described here, please do not use the Service.

2. Information We Collect

2.1 Account Information: When you create an account, we collect your name, email address, username, and password (stored in encrypted form).

2.2 Brand Profile Data: During onboarding and through subsequent updates, we collect business information that forms your brand profile, including business name, industry, and location; brand voice descriptors, tone preferences, and formality settings; target audience descriptions and customer profiles; brand differentiators and competitive positioning; brand colors, logos, and visual assets; content preferences including platforms, posting frequency, and content mix; products, services, and promotional information; and any additional information you choose to provide about your business.

2.3 Content and Usage Data: As you use the Service, we collect post request details and topics you submit; AI-generated content created for your account; edits, approvals, regeneration requests, and content preferences; publishing history and scheduling data; and interaction logs such as login times, feature usage, and session data.

2.4 Platform Connection Data: When you connect third-party social media accounts, we collect OAuth access tokens (stored encrypted) with scoped permissions, platform user identifiers, and publishing and scheduling permissions. We do not store your social media account passwords. We request only the minimum permissions necessary to publish and schedule content on your behalf.

2.5 Payment Information: When you subscribe to a paid plan, payment processing is handled by our third-party payment processor. We do not directly store your credit card number, bank account details, or other sensitive financial information. We may receive and store limited billing information such as the last four digits of your card, card type, billing address, and transaction history.

2.6 Communications: We collect information from communications you send to us, including support requests, feedback, and correspondence via email.

2.7 Automatically Collected Information: When you access the Service, we may automatically collect device information (browser type, operating system, device type), IP address, access times and dates, pages viewed and features used, and referral URLs.

2.8 Cookies and Similar Technologies: We use essential cookies required for the Service to function, such as session management and authentication. We do not use third-party advertising or tracking cookies. You can control cookie settings through your browser preferences.

3. How We Use Your Information

We use the information we collect for the following purposes:

Providing the Service: Generating AI-powered content tailored to your brand profile, publishing content to connected platforms, managing your account and subscription, and processing your post requests and content preferences.

Improving the Service: Analyzing usage patterns to improve features and functionality, training and refining our AI content generation models (see Section 5 for important details), identifying and fixing technical issues, and developing new features and capabilities.

Communication: Sending service-related notifications and updates, responding to your inquiries and support requests, providing weekly performance digests and content previews (where applicable), and notifying you of changes to our Terms or Privacy Policy.

Security and Compliance: Protecting against unauthorized access, fraud, and abuse, enforcing our Terms of Service, and complying with applicable legal obligations.

4. How We Share Your Information

Amplyfai does not sell, rent, or trade your personal information or business data to third parties. We may share your information only in the following limited circumstances:

Service Providers: We share information with third-party service providers who assist us in operating the Service, including cloud hosting and infrastructure providers, payment processors, email delivery services, and analytics tools. These providers are contractually obligated to use your information only for the purposes of providing services to Amplyfai and to maintain appropriate security measures.

Social Media Platforms: When you connect your social media accounts and authorize content publishing, we share the content you approve with the connected platforms via their APIs.

Legal Requirements: We may disclose your information if required to do so by law, court order, or governmental regulation, or if we believe in good faith that such disclosure is necessary to protect the rights, property, or safety of Amplyfai, our users, or the public.

Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such transfer and any choices you may have regarding your information.

With Your Consent: We may share your information with third parties when you have given us explicit consent to do so.

5. AI Training and Your Data

5.1 Brand Profile Isolation: Your brand profile data is isolated to your account. Your business information, brand voice, audience descriptions, and competitive positioning are never shared with or made accessible to other users or businesses.

5.2 No Cross-Pollination: We do not use one business's brand profile, content preferences, or proprietary information to generate content for another business. Each account's data is treated as separate and confidential.

5.3 AI Model Training: Amplyfai may use aggregated, anonymized usage data (such as general content performance patterns and feature usage statistics) to improve the overall quality of our AI generation models. We do not use your specific brand profile data, proprietary business information, or identifiable content to train shared AI models. If and when per-client fine-tuned models are offered, those models are trained exclusively on your account's approved content history and are not shared with or applied to any other account.

6. Data Security

We implement industry-standard security measures to protect your information, including encryption of all data in transit using TLS 1.3, encryption of all data at rest using AES-256, encrypted storage of OAuth tokens and authentication credentials, access controls limiting employee access to user data on a need-to-know basis, regular security assessments and monitoring, and secure infrastructure hosted by reputable cloud service providers.

While we strive to protect your information, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security. If we become aware of a security breach affecting your personal information, we will notify you in accordance with applicable law.

7. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service. Specifically, account and brand profile data is retained for the duration of your active account. Generated content and post history is retained for the duration of your active account. Usage and activity logs are retained for up to 24 months. Payment records are retained as required by applicable tax and financial regulations.

Upon account deletion, we will delete or anonymize your data within 30 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or enforcing our Terms).

8. Your Rights and Choices

8.1 Access and Portability: You have the right to access the information we hold about you. You may request a copy of your brand profile, generated content history, and account data at any time by contacting us at amplyfaiinc@gmail.com.

8.2 Correction: You may update or correct your account information and brand profile at any time through the Service. For other corrections, please contact us.

8.3 Deletion: You may request deletion of your account and all associated data at any time. Account deletion triggers full erasure of all associated data within 30 days. This includes your brand profile, generated content, post history, activity logs, and any uploaded assets. Amplyfai does not retain any proprietary business information after deletion.

8.4 Platform Disconnection: You may revoke Amplyfai's access to your connected social media accounts at any time, either through the Service or directly through the connected platform's settings. Revoking access will prevent future content publishing but will not delete previously published content.

8.5 Communication Preferences: You may opt out of non-essential communications by updating your notification preferences in your account settings or by following the unsubscribe instructions in our emails. You cannot opt out of essential service-related communications (such as billing notices and security alerts).

9. Children's Privacy

The Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information promptly. 10. International Data Transfers

Amplyfai is based in the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our service providers maintain facilities. By using the Service, you consent to the transfer of your information to countries that may have different data protection laws than your country of residence.

For users in the European Economic Area (EEA) or United Kingdom, we will ensure that appropriate safeguards are in place for any international data transfers, such as standard contractual clauses approved by the European Commission.

11. California Privacy Rights (CCPA)
